If that classification is still open, settle it first — the standard question is downstream of it and the answer changes completely if the instrument turns out not to be a security.

The first thing to know is that the question is not a compliance question, and treating it as one is the most common mistake at this stage.

No EU regulation names a token standard. Not the Prospectus Regulation, not AIFMD, not ELTIF, not the market-abuse regime. Every obligation in the EU securities stack is satisfiable under either standard below, or under neither. "EU compliance requires ERC-3643" is a vendor claim wearing a regulatory sentence.

What is true, and more useful: the regimes impose transfer-control, identity and remediation duties, and ERC-3643 is a standard built around exactly those. That makes it a strong default. It does not make it an obligation, and the difference matters the moment you write a conformance sentence into a disclosure document.

What it takes about choosing a token standard

Choosing a token standard doesn’t decide whether you are compliant or not. It decides three things mainly.

What you get readily made and what you build yourself. Some features come as a published standard, and the rest you write

How familiar your auditor already is with it. The more the auditor recognizes, the faster and easier/affordable your review is.

How much self-written code you end up with. This part takes the longest to audit because nobody has seen it before.

Picking up a token standard for tokenized securitis is the important hurdle you should cross on. And this guide compares ERC-3643 and ERC-1400 capability by capability, and shows where the custom work really sits.

Start with capabilities, not standards

The best possible way to find out which standards your project suits is to map out your instrument needs. Then you need to match it with both of the ERC standards.

For EU token issuance, these are the seven capabilities basically needed. A venue or dealer adds up more than these, but these are the core that any issuance to be built.

#

Capability

What forces it

1

Pre-validation transfer gate

Eligibility rules in every regime limit who may hold the token, and the tipping-off ban stops you telling a blocked person why. So every transfer must be checked first and refused without a reason.

2

Identity binding

Investor-classification and due-diligence duties apply to a person, and exemption headcounts count people, not wallets. So each wallet must resolve to one verified person.

3

Trusted attestation issuers with revocable claims

Rules that rely on third-party attestations, and periodic re-screening of investors, mean a claim can stop being valid. So claims must be revocable, with immediate effect on transferability.

4

Rule modularity

An auditor needs to match each Article to one function. So each rule must be a separate module that can be added, removed or upgraded alone.

5

Freeze, forced transfer and recovery

Regulators can order remediation, seize assets or direct transfers to an estate. So there must be a controlled way to freeze, force-move and recover tokens.

6

Partitions / tranches

Some instruments have side pockets, per-tranche lock-upsne or a pending subscription state. So balances must split into parts, each with its own rules.

7

Investor covenants

Duties like key-information delivery and declared-person registers depend on what the investor themselves acknowledged. So that acknowledgement must be recorded and tied to a document version.

This is also where a plain ERC-20 drops out, and it is worth being explicit about why.

It has no hook that can refuse a transfer on external logic —
transfer
moves the balance, which is the correct design for a fungible utility token. It therefore fails at capability 1, and because capability 1 is what every other rule attaches to, failing it fails all seven. You can add an allowlist to an ERC-20 token. The ERC-20 standard has no hook for this, so you must add your own. The result is a token that only approved wallets can use, with a non-standard interface. All the custom code is yours, and none of the recognition comes with it.

Paying for the security is a separate decision. The cash side of the deal is called the cash leg. That leg may well use an ERC-20 token. This brings its own consequences. If you pay with an e-money token, which is a token that represents money, rules for transfers of funds apply to that payment. These rules require the sender's and receiver's details to travel with the transfer. There is no minimum amount, so even a small payment counts.

So the shortlist is two.

Where the two standards actually differ

Capability

ERC-1400 suite

ERC-3643

Pre-validation gate

canTransfer
/
canTransferByPartition
— returns a status code

canTransfer
— returns a boolean

Identity binding

not specified — pair an external registry

specified

Trusted issuers / revocable claims

build on the paired identity layer

specified

Rule modularity

implementer's choice, commonly an external compliance contract

specified — one module per rule

Freeze / forced transfer / recovery

specified — controller operations

specified — agent roles, and the role model itself is specified

Partitions / tranches

specified — partially-fungible partitions

not specified — tranche logic is custom

Document anchoring

specified — via the ERC-1643 pattern

commonly paired with ERC-1643

Investor covenants

custom

custom

Two rows deserve more than a table cell.

The gate's return type is the one that surprises people. ERC-1400's check is designed to return an informative status code. That is helpful for a support desk and awkward under a regime where telling a customer they are under analysis is an individual criminal offence in most Member States. ERC-3643's boolean cannot disclose a reason to the caller even if a module author wanted it to. That reads as a limitation and is closer to a feature: the opacity is a property of the interface rather than a convention reviewers have to keep enforcing. Under either standard, per-module reasons belong above the gate and routed to the operator, never returned to the caller.

Neither standard covers investor covenants, whichever one you pick. Both standards are built around the issuer stating facts and third parties vouching for them. Neither records what the investor themselves said or confirmed. So you build that part yourself either way. For most EU issuer builds, it's more work than everything the standard does cover.

Status: one is a finalised ERC, the other is a family

ERC-3643 is a Final ERC with published interface files. ERC-1400 is a family of earlier proposals (ERC-1410, ERC-1594, ERC-1643, ERC-1644) that were never merged into the ERC register as of 13 October 2026. Status is not a compliance factor: no regulation names either standard.

The ERC3643 Association reports more than $32 billion in real-world assets tokenized on ERC-3643 (November 2025), and its T-REX Network site lists 120+ live deployments. Both figures are self-reported. We found no comparable public figure for ERC-1400.

What ERC-3643 does not give you

We build on ERC-3643, for the reason visible in rows two through four: identity binding, trusted issuers and rule modularity arrive as a published interface rather than as house convention, which lets an auditor who has seen the standard before read the Article-to-function map without learning our vocabulary first.

Three things that decision does not do, all of them routinely assumed:

It delivers no software. A standard doesn't give you any software. It is only a description of how the contracts must behave. Whoever builds the system still writes the contracts and has them audited. This also keeps two questions apart: whether you follow the standard, and whether you're allowed to use someone's code. The description is free for anyone to follow. The best-known ready-made code is released under GPL-3.0, a licence that can require you to open up your own code if you copy theirs. So an issuer that wants to keep its code private must decide this before anyone copies anything.

It does not cover the whole capability set. Partitions and covenants sit outside it, and document anchoring comes from a different standard entirely. ERC-3643-based is the accurate phrase. A build described as ERC-3643-only is under-scoped by its largest custom component.

It does not settle the identity model. It fixes the shape of the read, not what sits behind it.

The conformance claim, and why it is harder than it looks

The token standard you use must be stated in the prospectus. So if you write "fully ERC-3643 compliant", it has to be completely true. If it isn't, the prospectus contains an error. You can't fix that error with a code update. You fix it with a supplement to the prospectus, which gives investors a window to withdraw. If you follow only part of the standard, say so. Name the interfaces you implemented. List where you differ in a register published with the audit.

Two traps sit between a team and that sentence, and both are worth knowing before anyone writes it.

The specification body and the specification's asset directory are not the same thing.

At least one ERC-3643 interface exists only inline in the specification text, with no corresponding file in the repository's asset directory. Transcribe the standard by working through its machine-readable assets as any sensible engineer would and you produce an interface set that is complete against the listing, looks complete to a reviewer, and is short by one interface against the actual standard. Read the specification body, not the asset listing. Expect this from any standard whose repository ships partial assets, because it fails silently and always in the same direction.

The obvious conformance test does not test conformance.

It compares your contracts against your own interface files. That only proves the implementation matches your transcription. It cannot detect anything that never made it into the transcription. That is the failure described above. A check whose reference is a file your own team wrote is a consistency check. It only looks like a conformance check. It reports clean most confidently when the transcription is the part that is wrong.

Two rules follow. Compare against the specification's own published interface files. Compare full signatures rather than counting members. A substituted function keeps the count correct while changing the answer. If a conformance claim is going into a disclosure document, that distinction is the difference between an evidenced statement and a plausible one.

How to actually decide

These are leanings, not rules. Neither standard makes you compliant, and neither prevents it. So the decision reduces to four questions, in order:

Does the instrument need partitions? Tranches, side pockets, per-tranche lock-ups, a pending subscription state. If yes, ERC-1400 supplies them and ERC-3643 does not — this is the single largest capability swing between the two.

What does your auditor already read? Familiarity is not a soft factor. It is the difference between an auditor checking your Article-to-function map and an auditor first learning your vocabulary, and it shows up in cost and elapsed time.

What is your existing stack and what have you committed to interoperate with? A standard is an interface to other people's tooling. If nothing you integrate with speaks either, this question is null and the first two decide it.

Which custom surface would you rather own? ERC-3643 leaves you partitions and covenants. ERC-1400 leaves you identity binding, trusted issuers and the module architecture. Both lists are real work; the second is larger for most EU issuer builds, which is why we default to the first.

We built real estate on ERC-1400 and on ERC-3643

ERC-1400, DIVAC (US Reg S). Tokenized Florida vacation property for non-US investors. ERC-1410 partitions carried a 12-month Reg S restriction and a 5-year lock-up. We built the identity registry alongside it.

ERC-3643, UK real estate. A custom platform for a UK real estate firm under the FCA Appointed Representative regime. A permissioned identity registry enforces investor eligibility on-chain.

Both are real estate, yet the standards differ. What the instrument needs decides it, not the asset type.

What should not be on that list: whether the choice satisfies a regulator. It does not, either way. The obligations attach to the issuer and the instrument, and they are discharged by the controls you build. The standard only decides how much of that you inherit and how much you write.

Does asset type decide it?

Not directly. Two of our real estate builds used different standards: ERC-1400 for layered lock-ups, ERC-3643 for investor eligibility. Asset type matters only if it brings features such as tranches, side pockets or lock-ups. Decide on those features.

Where this leaves you

Picking a token standard feels like a big compliance decision. But It isn't. No EU rule names one, and either choice can meet the same obligations.

What it really changes is how much you get readily made, how much your auditor already knows, and how much you have to write yourself.

So start with what your instrument needs, not with the standard. Be honest about what neither one covers. Investor covenants are custom work either way, and partitions are custom work if you go with ERC-3643. When you describe the build in a disclosure document, say exactly what you implemented and where you differ.

If you're weighing ERC-3643 against ERC-1400 for a live issuance, that's the kind of build an RWA tokenization development company like ours takes on end-to-end.

ERC-3643 vs ERC-1400.
